Overview

Adams & Reese Counsel Victoria Edwards has more than two decades of experience as a litigator, appellate attorney, former partner at an AmLaw 100 firm, and as a solo practitioner.

Located in the A&R Denver office, Victoria has litigated for and advised clients across every industry, including the representation of large banking and financial institutions, insurance firms, oil and gas/mining companies, construction companies, and various small to medium-sized businesses on complex business matters, including contract formation and interpretation, commercial restructuring and bankruptcy issues. Victoria has also represented clients in labor and employment litigation, and across commercial and civil liability disputes, including trade secrets, business contracts, commercial law, breach of contract, and breach of duty of loyalty. 

Victoria was the first female homegrown partner of the National Consumer Finance Litigation & Compliance Practice Group at Akerman LLP, an AmLaw 100 firm. She also successfully ran her own law firm, serving as Managing Member of the Denver, Colorado-based Edwards Law PLLC.

Most recently, Victoria practices complex general commercial, civil and employment litigation, aggressively representing small businesses and general contractors in construction defect and mechanics lien litigation, and commercial breach of contract, business tort, and employment disputes. She also represents a limited number of individuals in civil lawsuits concerning disqualified 1031 exchanges, employment and qui tam matters.
In addition, Victoria represents small businesses through the employment administrative processes and advises on pre-litigation disputes, to assist clients in efficiently resolving issues of mechanic’s liens, defamation, trade secrets, breach of contract, misclassification and wage disputes, and tortious interference with contract and business relations.

Victoria rounds off her practice by assisting clients in forming, selling, and buying businesses, as well as reviewing, drafting, and advising on commercial leases, employment/ independent contractor agreements, service agreements, operating agreements, nondisclosure agreements, and noncompete agreements.

Victoria is licensed to practice law in four states – Colorado, California, New Jersey, and New York; has presented oral arguments to the U.S. Court of Appeals for the Eighth, Ninth, and Tenth Circuits; and has represented clients in the bankruptcy courts of Colorado and California.

  • Defended mortgage loan servicers, investors, and originators in class actions, individual lawsuits, and bankruptcy adversary cases.

  • Litigated mortgage loan servicing and lending issues for major financial institutions, concerning the Truth in Lending Act, the Real Estate Settlement Procedures Act, the Fair Credit Reporting Act, the Fair Debt Collection Practices Act, state fair lending laws, and collection and deceptive trade practice laws.

  • Presented oral arguments in the United States Court of Appeals for the Eighth, Ninth and Tenth Circuits and the Colorado Court of Appeals on critical issues governing the mortgage servicing industry. 

  • Obtained a favorable ruling for the foreclosure industry in Colorado when the Tenth Circuit affirmed the legality of Colorado’s foreclosure laws.

  • Obtained a favorable decision, affirming a California federal district court ruling in a wrongful foreclosure case, in the Ninth Circuit. The Court found no unfair business practices and no breach of the covenant of good faith and fair dealing or any implied or express contract concerning the modification of a borrower’s mortgage loan after the expiration of an in-house workout agreement.

  • Dismissed three putative class action lawsuits concerning loan modification issues and unfair business practices against large banking and financial servicing institutions.

  • Obtained a $150,000 settlement for a client who was illegally discriminated against and wrongfully terminated for having a disability.

  • Obtained generous settlement for a client who experienced workplace harassment and was wrongfully terminated.
